By accessing or using this website, placing an order, or engaging with us (including via email or social platforms), you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website.

These Terms & Conditions govern:

  • your use of the website,

  • how orders work,

  • pricing and payment,

  • shipping and delivery,

  • exchanges,

  • limitations of liability,

  • and your responsibilities as a customer.


1. Use of the Website

1.1 You agree to use this website for lawful purposes only.
1.2 You may not use this website in any way that could damage, disable, overburden or impair the website, or interfere with any other person’s use of the website.
1.3 All content on this site (including product descriptions, logos, images, layout, copy, packaging wording, etc.) is owned by or licensed to The Ivory Pearl Collective and is protected by copyright, branding and intellectual property laws. You may not copy, reproduce, modify, distribute, or use our content for commercial purposes without our written consent.


2. Products and Availability

2.1 We try to make sure product images and descriptions are accurate and true to the actual item (including colour, fabric and fit). However, slight variation may occur due to lighting, editing, fabric batches, or screen settings.
2.2 All products are offered subject to availability. Adding an item to your cart does not guarantee that the item will be available at checkout.
2.3 We reserve the right to limit quantities, discontinue items, or refuse orders where necessary (for example, suspected fraud or abusive behaviour).


3. Pricing

3.1 All prices shown on theivorypearl.co.za are listed in South African Rand (ZAR).
3.2 Prices are subject to change at any time without notice.
3.3 If an item was displayed at an incorrect price due to an error, we reserve the right to cancel any order placed at the incorrect price. If payment has already been made, we will contact you and discuss next steps (replacement item / store credit / cancellation of that line item).
3.4 Promotions, discounts, and free shipping offers may be time-limited or subject to minimum spend. These promotional terms form part of these Terms & Conditions for as long as they are active.


4. Payment

4.1 Payment must be made in full at checkout for your order to be processed.
4.2 We use third-party payment providers (for example, payment gateways, card processors). By checking out, you authorise us and our payment provider(s) to process your payment.
4.3 We do not store your full card details on our server.
4.4 If your payment is flagged as high risk or fails verification, we may place your order on hold or cancel it.


5. Order Processing

5.1 Orders are processed within 1–2 business days (business days are Monday–Friday, excluding public holidays).
5.2 You will receive an order confirmation email after successful checkout.
5.3 If an item in your order becomes unavailable after checkout (for example, last unit sold simultaneously in-store and online), we will contact you using the details you provided.


6. Shipping & Delivery

6.1 Local delivery (within South Africa) typically takes 2–5 business days after dispatch. Delivery timing may vary due to courier delays, remote areas, peak seasons, etc.
6.2 Shipping fees are calculated at checkout based on your location. You’ll see the final shipping amount before payment.
6.3 Free shipping may apply to orders over our stated threshold (for example, R1500). Minimum spend requirements are calculated after discounts but before shipping.
6.4 When your order is dispatched, we’ll send you a tracking link via email so you can follow your parcel.
6.5 Please ensure your delivery details are correct. If the courier cannot deliver due to an incorrect or incomplete address, or if delivery attempts fail, additional re-delivery costs may apply.
6.6 Once a parcel is marked “delivered” by the courier, responsibility for that parcel passes to you.

7. Exchanges, Returns & Store Credit

7.1 We offer exchanges only. We do not offer refunds.
7.2 You may request an exchange within 14 days of delivery of your order.
7.3 To qualify for an exchange:

  • The item must be unworn, unwashed, undamaged, and in original condition.

  • All original tags and labels must still be attached.

  • The item must not be a white garment.

  • The item must not be a sale/discounted item.

7.4 White garments are final sale and cannot be exchanged.
7.5 Sale / marked-down / promotional items are final sale and cannot be exchanged.
7.6 If an item shows make-up marks, perfume/deodorant scent, self-tan transfer, stretching, pet hair, pulls, snags, laundering, or missing tags, we will not accept it for exchange.

7.7 How to request an exchange:

7.8 You are responsible for the cost of sending the item back to us, unless we have confirmed the item is faulty. We recommend using a tracked courier.
7.9 Exchanges are subject to stock availability at the time we receive and inspect the return. If we cannot supply the requested replacement, we may offer you a store credit / gift voucher of equivalent value.

7.10 Approved exchanges or store credits will only be processed after we receive and inspect the returned item.

7.11 If you send items back without contacting us first, or after the 14-day window, or in non-original condition, we may reject the return and send it back to you at your cost.

8. Faulty / Incorrect Items

8.1 We take quality seriously. If you believe you received a faulty item or the wrong item, please contact us at hello@theivorypearlcollectiv.co.za within 14 days of delivery, including clear photos of the fault and your order number.
8.2 We will assess the item. Manufacturing faults or fulfilment errors (wrong size sent, etc.) will be prioritised, and in those cases we will cover reasonable return shipping.
8.3 Normal wear and tear, damage caused by incorrect washing or care, or damage caused by you does not count as a manufacturing fault.


9. User Accounts (if applicable)

If the website offers account creation:

9.1 You are responsible for keeping your login details (email/password) secure.
9.2 You are responsible for all activity under your account.
9.3 If you believe your account has been accessed without permission, you must notify us immediately so we can suspend or secure it.
9.4 We may suspend or close accounts that appear to be abusive, fraudulent, or in breach of these Terms & Conditions.


10. Privacy & Personal Information

10.1 We respect your privacy. We collect and process your personal information in order to:

  • take and deliver orders,

  • communicate with you,

  • handle exchanges,

  • improve our service,

  • comply with legal obligations (including fraud prevention and tax).

10.2 By placing an order or contacting us, you consent to us processing your personal information for these purposes.

10.3 We will take reasonable steps to protect your personal information and keep it secure. We do not sell your personal information.

10.4 Our full Privacy Policy (which includes your rights under South African privacy law and POPIA) forms part of these Terms & Conditions. By using this site, you agree to the Privacy Policy.


11. Limitation of Liability

11.1 To the maximum extent allowed by law, The Ivory Pearl Collective is not liable for:

  • any indirect, incidental, special, punitive, or consequential damages,

  • loss of profits or revenue,

  • loss of data,

  • or any claim arising from your misuse of the website, incorrect use of a product, failure to follow care instructions, or failure to provide accurate delivery information.

11.2 We are responsible only for losses that are:

  • directly caused by us,

  • reasonably foreseeable,

  • and not excluded by these Terms & Conditions or by law.

11.3 Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.


12. Indemnity

You agree to indemnify and hold The Ivory Pearl Collective harmless against any claim, loss, liability, damage, cost or expense (including legal fees) arising from:

  • your breach of these Terms & Conditions,

  • your misuse of this website,

  • your violation of any law or third party rights.

This basically means: if you use the site in a way that causes us trouble, you take responsibility for the fallout.


13. Force Majeure

We’re not responsible for any delay or failure to perform our obligations if it’s caused by something beyond our reasonable control — for example: courier strikes, severe weather, load shedding that affects dispatch, riots/unrest, natural disaster, pandemic-related lockdowns or restrictions, or major supplier issues.


14. Changes to These Terms

We may update these Terms & Conditions from time to time.

  • The “Last updated” date at the top will change when we do.

  • Continued use of the website after changes means you accept the updated Terms & Conditions.

It’s your responsibility to review this page periodically.


15. Governing Law

These Terms & Conditions are governed by the laws of South Africa. Any disputes arising from or related to these Terms & Conditions, our products, or the use of this website shall be handled under South African jurisdiction.
